Il est install\u00e9 dans une zone non class\u00e9e alors que le fabricant, lors de l&rsquo;\u00e9valuation des risques, a d\u00e9fini une zone 0 \u00e0 l&rsquo;int\u00e9rieur. Doit-il \u00eatre marqu\u00e9 CE de <strong>cat\u00e9gorie 1<\/strong> conform\u00e9ment \u00e0 la directive sur les produits ATEX, ce qui implique l&rsquo;intervention d&rsquo;un organisme notifi\u00e9 avant sa mise sur le march\u00e9 ? <strong>La r\u00e9ponse est non.<\/strong><\/p>\n<p>La directive ATEX s&rsquo;applique aux \u00e9quipements install\u00e9s dans des zones class\u00e9es ATEX, c&rsquo;est-\u00e0-dire dans des zones class\u00e9es avant l&rsquo;installation de la machine. Voici ce que dit la directive :<\/p>\n<blockquote><p><em>[2014\/35\/EU] <strong>Article 1 &#8211; Champ d&rsquo;application<\/strong><\/em><br \/>\n<em>1. La pr\u00e9sente directive s&rsquo;applique aux produits suivants, ci-apr\u00e8s d\u00e9nomm\u00e9s \u00ab\u00a0produits\u00a0\u00bb :<\/em><br \/>\n<em>(a) les appareils et les syst\u00e8mes de protection destin\u00e9s \u00e0 \u00eatre utilis\u00e9s en atmosph\u00e8res explosibles ;<\/em><\/p><\/blockquote>\n<p>Et ce que dit le guide officiel :<\/p>\n<blockquote><p><em>[2014\/35\/UE] <strong>\u00a7 34 Lieu d&rsquo;utilisation pr\u00e9vu<\/strong><\/em><\/p>\n<p><em>[&#8230;] Il est important de souligner dans ce contexte comment les machines ayant une atmosph\u00e8re potentiellement explosive \u00e0 l&rsquo;int\u00e9rieur dans les conditions de fonctionnement, mais n&rsquo;ayant pas d&rsquo;interface avec des atmosph\u00e8res potentiellement explosives externes, doivent \u00eatre consid\u00e9r\u00e9es. Ces machines, en tant que partie int\u00e9grante, ne rel\u00e8vent pas du champ d&rsquo;application de la directive ATEX 2014\/34\/UE.<\/em><\/p><\/blockquote>\n<p>La m\u00eame approche s&rsquo;applique \u00e0 la directive \u00ab\u00a0Machines\u00a0\u00bb. Ci-apr\u00e8s le langage de son guide officiel :<\/p>\n<blockquote><p><em>[2006\/42\/CE] ANNEXE I :<strong> Exigences essentielles de sant\u00e9 et de s\u00e9curit\u00e9 relatives \u00e0 la conception et \u00e0 la construction des machines<\/strong><\/em><\/p>\n<p><em><strong>1.5.7 Explosion<\/strong>. La machine doit \u00eatre con\u00e7ue et construite de mani\u00e8re \u00e0 \u00e9viter tout risque d&rsquo;explosion du fait de la machine elle-m\u00eame ou du fait des gaz, liquides, poussi\u00e8res, vapeurs ou autres substances produites ou utilis\u00e9es par la machine [&#8230;].<\/em><\/p><\/blockquote>\n<p>Le guide officiel de la directive \u00ab\u00a0Machines\u00a0\u00bb contient le texte suivant :<\/p>\n<blockquote><p><em>[Guide 2006\/42\/CE]<strong> \u00a7228 Explosion<\/strong><\/em><\/p>\n<p><em>[\u2026]Bien que la directive ATEX ne soit pas applicable en tant que telle aux risques d&rsquo;explosion g\u00e9n\u00e9r\u00e9s \u00e0 l&rsquo;int\u00e9rieur de la machine elle-m\u00eame, [&#8230;]<\/em><\/p><\/blockquote>\n<p><strong>CONCLUSION :<\/strong><\/p>\n<p data-start=\"125\" data-end=\"413\">Lorsque l\u2019\u00e9quipement, l\u2019ensemble ou, plus g\u00e9n\u00e9ralement, la machine contient une atmosph\u00e8re potentiellement explosive, une \u00e9valuation des risques doit \u00eatre r\u00e9alis\u00e9e conform\u00e9ment \u00e0 la norme EN 1127-1 ainsi qu\u2019\u00e0 l\u2019ensemble des normes harmonis\u00e9es applicables \u00e0 la directive ATEX \u00ab Produits \u00bb.<\/p>\n<p data-start=\"415\" data-end=\"742\">Si des \u00e9quipements, tels que des instruments, sont install\u00e9s \u00e0 l\u2019int\u00e9rieur de la machine, ils doivent \u00eatre conformes \u00e0 la directive ATEX 2014\/34\/UE et porter le marquage CE correspondant.
