LE DOUTE<\/strong>\u00a0:<\/p>\n

En travaillant tous les jours avec des fabricants de machines, on nous pose souvent la question : \u00ab\u00a0Est-il obligatoire de fournir \u00e0 notre client le <\/strong>la notice d\u2019instructions de la machine en format papier ?\u00a0\u00bb<\/strong><\/p>\n

 <\/p>\n

CONSID\u00c9RATIONS<\/strong><\/p>\n

La publication le 18 avril 2024 du Guide d’application de la directive Machines 2006\/42\/CE<\/strong> clarifie le fait que le fabricant d’une machine n’est pas oblig\u00e9 de fournir la notice d’instruction<\/strong> et la d\u00e9claration de conformit\u00e9 sous forme papier<\/strong>.<\/p>\n

Cette obligation \u00e9tait due au fait qu’\u00e0 l’\u00e9poque de la publication de la directive \u00ab Machines \u00bb 2006\/42\/CE, l’utilisation d’Internet et d’autres formats num\u00e9riques n’\u00e9tait pas encore aussi r\u00e9pandue et accessible qu’aujourd’hui. Par cons\u00e9quent, afin de garantir que les utilisateurs de machines aient acc\u00e8s aux notices d’utilisation correspondantes, la seule option viable \u00e9tait de fournir une version papier.<\/p>\n

Avec le R\u00e8glement Machines, publi\u00e9 en 2024, ce fait est reconnu et, par cons\u00e9quent, cette obligation a \u00e9t\u00e9 supprim\u00e9e, non seulement parce que les moyens de communication ont maintenant \u00e9volu\u00e9 et sont devenus plus r\u00e9pandus, mais aussi pour r\u00e9duire le co\u00fbt et l’impact environnemental de la fourniture de notices en format papier.<\/p>\n

Toutefois, le nouveau R\u00e8glement reconna\u00eet \u00e9galement le fait que l’acc\u00e8s aux formats num\u00e9riques est encore limit\u00e9 dans certains environnements, de sorte que, pour r\u00e9pondre aux besoins de tous, l’article 10 du nouveau R\u00e8glement stipulera ce qui suit :<\/p>\n

 <\/p>\n

Article 10 \u2013 Paragraph 7 \u2013 Obligations of manufacturers of machinery and related product<\/strong><\/p>\n

[\u2026] The instructions may be provided in a digital format<\/strong>. [\u2026] However, at the request of the user<\/strong> at the time of the purchase, the manufacturer shall provide the instructions<\/strong> for use in paper format free of charge<\/strong> within one month.<\/em><\/p><\/blockquote>\n

 <\/p>\n

Actuellement, l’exigence suivante est \u00e9nonc\u00e9e dans la norme EN ISO 12100, en vigueur depuis 2010 :<\/p>\n

Durability and availability of the documents: documents giving instructions for use should be produced in durable form (i.e. they should be able to survive frequent handling by the user). It can be useful to mark them \u201ckeep for future reference\u201d. Where information for use is kept in electronic form (CD, DVD, tape, hard disk, etc.), information on safety-related issues that need immediate action shall always be backed up with a hard copy that is readily available<\/strong>.<\/em><\/p>\n

D’apr\u00e8s cette exigence, il semblerait qu’il soit d\u00e9j\u00e0 possible de fournir des notices d’instructions en format num\u00e9rique, mais la norme pr\u00e9cise que les informations sur les questions de s\u00e9curit\u00e9 n\u00e9cessitant une action imm\u00e9diate doivent toujours \u00eatre accompagn\u00e9es d’une copie papier facilement accessible<\/strong>.<\/p>\n

Cependant, en 2019 a \u00e9t\u00e9 publi\u00e9e la norme EN ISO 20607<\/u>, qui porte sur la r\u00e9daction de notices d’instructions pour les machines<\/strong>. Elle est align\u00e9e sur la norme EN ISO 12100, mais indique clairement que la notice d’instructions doit \u00eatre fournie sous la forme convenue avec le client<\/strong> (et les diff\u00e9rentes formes possibles comprennent \u00e0 la fois le format papier et le format num\u00e9rique<\/strong>).<\/p>\n

Enfin, le Nouveau R\u00e8glement Machines<\/strong> pr\u00e9cise qu’il est possible, en accord avec le client, de fournir la Notice d’Instructions et d’Entretien uniquement en format num\u00e9rique, mais avec certaines restrictions.<\/p>\n

 <\/p>\n

Article 10 \u2013 Obligations of manufacturers of machinery and related products<\/em><\/strong><\/p>\n

When the instructions for use are provided in digital format, the manufacturer shall:<\/em><\/p>\n

(a) mark on the machinery or related product, or, where that is not possible, on its packaging or in an accompanying <\/em>document, how to access the digital instructions;<\/em><\/p>\n

(b) present them in a format that makes it possible for the user to print and download the instructions for use and save <\/em>them on an electronic device so that he or she can access them at all times, in particular during a breakdown of the <\/em>machinery or related product; this requirement also applies where the instructions for use are embedded in the <\/em>software of the machinery or related product;<\/em><\/p>\n

(c) make them accessible online during the expected lifetime of the machinery or related product and for at least 10 <\/em>years after the placing on the market of the machinery or related product.<\/em><\/p><\/blockquote>\n

 <\/p>\n

Toutefois, \u00e0 la demande de l’utilisateur au moment de l’achat ou jusqu’\u00e0 un mois apr\u00e8s l’achat<\/strong>, le fabricant est tenu de fournir gratuitement la notice d’instructions sur papier.<\/p>\n

La nouvelle \u00e9dition du guide de la Directive Machines<\/strong> publi\u00e9e le 18 avril 2024 indique que pas moins de 93 % des m\u00e9nages de l’UE ont aujourd’hui acc\u00e8s \u00e0 Internet. Dans ces conditions et \u00e0 la lumi\u00e8re des dispositions du nouveau R\u00e8glement Machines sur le format de la notice d’instructions, on peut supposer que le respect de ces dispositions, y compris l’obligation de fournir les informations essentielles de s\u00e9curit\u00e9 en format papier dans le cas d’une utilisation non professionnelle, assure \u00e9galement le respect des dispositions de la Directive Machines.<\/p>\n

CONCLUSIONS<\/strong><\/p>\n

La Directive Machines, norme de r\u00e9f\u00e9rence pour l’\u00e9valuation de la conformit\u00e9 des machines \u00e0 usage industriel, stipule que la notice d’instructions doit \u00eatre fournie en version papier. En 2023 a \u00e9t\u00e9 publi\u00e9 le texte du R\u00e8glement Machines qui n’autorise la fourniture de la notice d’instructions qu’en version num\u00e9rique. Malheureusement, le r\u00e8glement n’entrera en vigueur qu’en 2027. Toutefois, la publication du nouveau guide de la Directive Machines en avril 2024 permet d\u00e9j\u00e0 de fournir ces documents en format num\u00e9rique. Par cons\u00e9quent, \u00e0 partir d’aujourd’hui, nous consid\u00e9rons qu’il n’est plus n\u00e9cessaire de fournir des notices d’instructions en format papier, \u00e0 moins que le client ne le demande express\u00e9ment<\/strong>.<\/p>\n<\/div> <\/div>\n \n \n
