class=\"a-text font-text text-base normal mt-8 first:mt-0 space-y-4\">\n    <p><strong>LA QUESTION :<\/strong><\/p>\n<p>Quel comportement faut-il prendre en compte lors de l&rsquo;\u00e9valuation des risques d&rsquo;une machine ?<\/p>\n<p><strong>CONSID\u00c9RATIONS : <\/strong><\/p>\n<p>L&rsquo;une des phrases parfois utilis\u00e9es lors de l&rsquo;\u00e9valuation des risques d&rsquo;<strong>une machine est que la machine doit \u00eatre con\u00e7ue pour une \u00ab\u00a0personne stupide\u00a0\u00bb.<\/strong> Cette phrase n&rsquo;est pas vraiment utile, car si une personne p\u00e9n\u00e8tre dans un four industriel contenant un morceau de m\u00e9tal \u00e0 800\u00b0C, nous pouvons dire qu&rsquo;elle est idiote, mais <strong>nous devons emp\u00eacher cette situation de se produire<\/strong>, tout en proc\u00e9dant \u00e0 l&rsquo;\u00e9valuation des risques du four.<\/p>\n<p>Conform\u00e9ment \u00e0 la directive sur les machines, le fabricant doit analyser tous les comportements attendus qui rel\u00e8vent de deux cat\u00e9gories :<\/p>\n<ul>\n<li><strong>Utilisation pr\u00e9vue<\/strong>. Dans une presse \u00e0 alimentation manuelle, il est normal que l&rsquo;op\u00e9rateur doive mettre ses mains sous la presse, afin de placer la pi\u00e8ce de m\u00e9tal \u00e0 travailler.<\/li>\n<li><strong>Mauvaise utilisation raisonnablement pr\u00e9visible.<\/strong> Dans le cas d&rsquo;un four industriel dont les parois ext\u00e9rieures sont \u00e0 une temp\u00e9rature sup\u00e9rieure \u00e0 70\u00b0C, il n&rsquo;est pas correct que quelqu&rsquo;un touche les parois (ce qui signifie qu&rsquo;il ne s&rsquo;agit pas d&rsquo;un comportement intentionnel), mais cela peut \u00eatre possible, parce que, par exemple, l&rsquo;agent d&rsquo;entretien doit travailler pr\u00e8s de la paroi pour changer un thermocouple. Dans une machine textile, l&rsquo;op\u00e9rateur ne devrait pas toucher le fuseau d&rsquo;une machine \u00e0 filer (le fuseau d&rsquo;une machine textile) ; cependant, il peut le faire pour enlever du coton qui pourrait nuire \u00e0 la qualit\u00e9 du produit et il le fait avec la machine en marche pour ne pas arr\u00eater la production. Il s&rsquo;agit dans les deux cas de mauvais comportements\u00a0 mais pr\u00e9visibles.<\/li>\n<\/ul>\n<p>Ci-apr\u00e8s, le premier principe g\u00e9n\u00e9ral de l&rsquo;\u00e9valuation des risques :<\/p>\n<blockquote><p><em>[Directive Machines 2006\/42\/CE] &#8211; ANNEXE I &#8211; PRINCIPES G\u00c9N\u00c9RAUX<\/em><\/p>\n<p><em>1. Le fabricant d&rsquo;une machine ou son mandataire doit veiller \u00e0 ce qu&rsquo;une \u00e9valuation des risques soit effectu\u00e9e afin de d\u00e9terminer les exigences de sant\u00e9 et de s\u00e9curit\u00e9 qui s&rsquo;appliquent \u00e0 la machine. La machine doit ensuite \u00eatre con\u00e7ue et construite en tenant compte des r\u00e9sultats de l&rsquo;\u00e9valuation des risques.<\/em><\/p>\n<p><em>Par le processus it\u00e9ratif d&rsquo;\u00e9valuation et de r\u00e9duction des risques vis\u00e9 ci-dessus, le fabricant ou son mandataire doit :<\/em><\/p>\n<p><em>d\u00e9terminer les limites de la machine, qui incluent l&rsquo;usage pr\u00e9vu et tout mauvais usage raisonnablement pr\u00e9visible de celle-ci, [&#8230;]<\/em><\/p><\/blockquote>\n<p>Il ne s&rsquo;agit pas d&rsquo;un principe d\u00e9cid\u00e9 par l&rsquo;\u00e9quipe qui a r\u00e9dig\u00e9 la directive Machines. <strong>Il s&rsquo;agit plut\u00f4t d&rsquo;un principe g\u00e9n\u00e9ral, commun \u00e0 toutes les directives europ\u00e9ennes sur les produits<\/strong>. Voici la formulation importante du Guide bleu (\u00e9dition 2016) :<\/p>\n<blockquote><p><em>[Guide bleu 2016] 2. QUAND S&rsquo;APPLIQUE LA LEGISLATION D&rsquo;HARMONISATION DE L&rsquo;UNION SUR LES PRODUITS ?<\/em><\/p>\n<p><em>[&#8230;]<\/em><\/p>\n<p><em>2.7. UTILISATION PR\u00c9VUE\/MAUVAISE UTILISATION.<\/em><\/p>\n<p><em>Les fabricants doivent assurer un niveau de protection correspondant \u00e0 l&rsquo;usage qu&rsquo;ils prescrivent pour le produit dans les conditions d&rsquo;utilisation raisonnablement pr\u00e9visibles.<\/em><\/p>\n<p><em>En ce qui concerne les activit\u00e9s de surveillance du march\u00e9, les autorit\u00e9s de surveillance du march\u00e9 sont tenues de v\u00e9rifier la conformit\u00e9 d&rsquo;un produit :<\/em><\/p><\/blockquote>\n<ul>\n<li>\n<blockquote><p><em>conform\u00e9ment \u00e0 sa destination (telle que d\u00e9finie par le fabricant) et<\/em><\/p><\/blockquote>\n<\/li>\n<li>\n<blockquote><p><em>dans les conditions d&rsquo;utilisation raisonnablement pr\u00e9visibles, c&rsquo;est-\u00e0-dire lorsque cette utilisation peut r\u00e9sulter d&rsquo;un comportement humain licite et ais\u00e9ment pr\u00e9visible.<\/em><\/p><\/blockquote>\n<\/li>\n<\/ul>\n<p><strong>Conclusion<\/strong><\/p>\n<p>La machine doit \u00eatre s\u00fbre lorsqu&rsquo;elle est utilis\u00e9e conform\u00e9ment \u00e0 ce que le fabricant a pr\u00e9vu comme \u00e9tant un bon comportement . Toutefois, les mauvais comportements , qui peuvent \u00eatre dus \u00e0 une raison raisonnablement pr\u00e9visible, doivent \u00eatre s\u00fbrs et donc \u00eatre pris en compte dans une \u00e9valuation des risques. Cette clarification est essentielle compte tenu de l&rsquo;importance croissante de la s\u00e9curit\u00e9 dans les machines.<\/p>\n<p>Si la machine peut \u00eatre connect\u00e9e et, d&rsquo;une mani\u00e8re ou d&rsquo;une autre, command\u00e9e \u00e0 distance, il est important d&rsquo;adopter des pr\u00e9cautions qui emp\u00eachent d&rsquo;affecter le syst\u00e8me de s\u00e9curit\u00e9 et donc de cr\u00e9er une situation dangereuse. Mais jusqu&rsquo;o\u00f9 ces pr\u00e9cautions doivent-elles aller ? En 2021, nous avons assist\u00e9 \u00e0 une augmentation des cyberattaques par ce que The Economist a d\u00e9fini comme des \u00ab\u00a0Broadbandits\u00a0\u00bb. Le fabricant de machines doit-il adopter des syst\u00e8mes de s\u00e9curit\u00e9 qui emp\u00eacheront les cyberattaques ? La r\u00e9ponse est non.
