Cette machine <strong>sera marqu\u00e9e CE une fois qu&rsquo;elle aura \u00e9t\u00e9 mise sur le march\u00e9 par son fabricant.<\/strong><\/p>\n<p>Toutefois, dans certaines situations, le fabricant ne poss\u00e8de que des comp\u00e9tences en m\u00e9canique et souhaite vendre sa \u00ab\u00a0machine\u00a0\u00bb sans aucune partie \u00e9lectrique, hydraulique ou pneumatique.<\/p>\n<p>Est-il oblig\u00e9 de certifier l&rsquo;ensemble ? L&rsquo;ensemble est-il soumis \u00e0 la directive \u00ab\u00a0Machines\u00a0\u00bb ?<\/p>\n<p><strong>CONSID\u00c9RATIONS :<\/strong><\/p>\n<p>Commen\u00e7ons par la d\u00e9finition de la machine :<\/p>\n<p><strong>[2006\/42\/CE] Article 2 &#8211; D\u00e9finitions<\/strong><\/p>\n<p>Aux fins de la pr\u00e9sente directive, le terme \u00ab\u00a0machine\u00a0\u00bb d\u00e9signe les produits \u00e9num\u00e9r\u00e9s \u00e0 l&rsquo;article 1er , paragraphe 1, points a) \u00e0 f). Les d\u00e9finitions suivantes s&rsquo;appliquent :<\/p>\n<blockquote><p><em>(a) \u00ab\u00a0machine\u00a0\u00bb: :<\/em><\/p>\n<p><em>un ensemble, \u00e9quip\u00e9 ou destin\u00e9 \u00e0 \u00eatre \u00e9quip\u00e9 d&rsquo;un syst\u00e8me d&rsquo;entra\u00eenement autre que l&rsquo;effort humain ou animal directement appliqu\u00e9, constitu\u00e9 de pi\u00e8ces ou d&rsquo;organes li\u00e9s entre eux, dont au moins un est mobile, et qui sont r\u00e9unis en vue d&rsquo;une application d\u00e9finie,<\/em><\/p>\n<p>Avec le terme \u00ab\u00a0syst\u00e8me d&rsquo;entra\u00eenement\u00a0\u00bb, la directive fait r\u00e9f\u00e9rence soit \u00e0 la partie \u00e9lectrique, soit \u00e0 l&rsquo;hydraulique, soit \u00e0 toute \u00e9nergie pouvant g\u00e9n\u00e9rer un mouvement de l&rsquo;ensemble m\u00e9canique. Lisons ce que dit le Guide de la directive machines \u00e0 propos de la d\u00e9finition ci-dessus :<\/p><\/blockquote>\n<p><strong>[Guide de la directive \u00ab\u00a0Machines\u00a0\u00bb : 2019] \u00a735 La d\u00e9finition de base]<\/strong><\/p>\n<blockquote><p><em>[&#8230;] En g\u00e9n\u00e9ral, le fabricant d&rsquo;une machine compl\u00e8te fournit la machine \u00e9quip\u00e9e de son syst\u00e8me d&rsquo;entra\u00eenement. Toutefois, les machines destin\u00e9es \u00e0 \u00eatre \u00e9quip\u00e9es d&rsquo;un syst\u00e8me d&rsquo;entra\u00eenement mais livr\u00e9es sans ce dernier peuvent \u00e9galement \u00eatre consid\u00e9r\u00e9es comme des machines.<\/em><\/p>\n<p><em>[&#8230;] Pour les machines fournies sans syst\u00e8me d&rsquo;entra\u00eenement :<\/em><\/p><\/blockquote>\n<ul>\n<li>\n<blockquote><p><em>l&rsquo;\u00e9valuation des risques par le fabricant doit prendre en compte tous les risques associ\u00e9s \u00e0 la machine, y compris ceux li\u00e9s au syst\u00e8me d&rsquo;entra\u00eenement \u00e0 installer sur la machine &#8211; voir \u00a7 158 : commentaires concernant le principe g\u00e9n\u00e9ral 1 de l&rsquo;annexe I ;<\/em><\/p><\/blockquote>\n<\/li>\n<li>\n<blockquote><p><em>le fabricant de la machine doit indiquer dans sa notice d&rsquo;instructions toutes les sp\u00e9cifications n\u00e9cessaires pour le syst\u00e8me d&rsquo;entra\u00eenement \u00e0 installer, telles que le type, la puissance et les moyens de connexion, et fournir des instructions pr\u00e9cises pour le montage du syst\u00e8me d&rsquo;entra\u00eenement &#8211; voir \u00a7264 : commentaires concernant la section 1.7.4.2, point i), de l&rsquo;annexe I ;<\/em><\/p><\/blockquote>\n<\/li>\n<li>\n<blockquote><p><em>l&rsquo;\u00e9valuation de la conformit\u00e9 de la machine doit couvrir les sp\u00e9cifications du syst\u00e8me d&rsquo;entra\u00eenement \u00e0 installer et la notice d&rsquo;instructions ;<\/em><\/p><\/blockquote>\n<\/li>\n<li>\n<blockquote><p><em>le marquage \u00ab\u00a0CE\u00a0\u00bb de la machine et la d\u00e9claration \u00ab\u00a0CE\u00a0\u00bb de conformit\u00e9 qui accompagne la machine doivent couvrir les sp\u00e9cifications et les instructions relatives au syst\u00e8me d&rsquo;entra\u00eenement \u00e0 installer.<\/em><\/p><\/blockquote>\n<\/li>\n<\/ul>\n<p>Si les conditions ci-dessus ne sont pas remplies, <strong>la machine dont le syst\u00e8me d&rsquo;entra\u00eenement n&rsquo;est pas enti\u00e8rement sp\u00e9cifi\u00e9 doit \u00eatre consid\u00e9r\u00e9e comme une quasi-machine (PCM).<\/strong><\/p>\n<p><strong>CONCLUSIONS<\/strong><\/p>\n<p>Un ensemble m\u00e9canique sans syst\u00e8me d&rsquo;entra\u00eenement doit \u00eatre marqu\u00e9 CE ou recevoir le statut de machine partiellement achev\u00e9e. Il s&rsquo;agit d&rsquo;une obligation de l&rsquo;ensemble m\u00e9canique.
