It is installed in a non-classified area while the manufacturer, during the risk assessment, has defined a Zone 0 inside it. Shall it be CE Marked <strong>Category 1<\/strong> according to the ATEX Product Directive, therefore involving a Notified Body before it is placed on the market? <strong>The answer is no.<\/strong><\/span><\/p>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><span style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">The ATEX Directive is applicable to Equipment installed in ATEX Classified Areas, in other words in areas that are classified before the machine is installed. Here what the directive states:<\/span><\/p>\n<blockquote>\n<p style=\"margin: 0cm 35.35pt 0cm 42.55pt;\"><span style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">[2014\/35\/EU]<strong> Article 1 &#8211;\u00a0Scope<\/strong><br \/>\n1.\u00a0This Directive shall apply to the following, hereinafter referred to as \u201cproducts\u201d:<br \/>\n(a) equipment and protective systems intended for use in potentially explosive atmospheres;<\/span><\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><span style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">And here is what the Official ATEX Guide states:<\/span><\/p>\n<blockquote>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><em>[ATEX 2014\/34\/EU GUIDELINES: 2024] <strong>\u00a7 34 Place of intended use<\/strong><\/em><\/p>\n<p style=\"margin: 0cm 49.55pt 0cm 42.55pt;\"><em><span style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">[\u2026] It is important to underline in this context how machinery\u00a0having a potentially\u00a0explosive atmosphere inside under operating conditions, but having no interface to\u00a0external potentially explosive atmospheres has to be considered.\u00a0<u>Such machines, as\u00a0an integral whole, do not fall under scope of the ATEX Directive 2014\/34\/EU.\u00a0<\/u><\/span><\/em><\/p>\n<\/blockquote>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><span style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">The same approach is for the Machinery Directive. Hereafter the language from its official guide:<\/span><\/p>\n<blockquote>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">[2006\/42\/EC] \u00a0<em>ANNEX I:<strong> Essential health and safety requirements relating to the the design and construction of machinery<\/strong><\/em><\/p>\n<p><em><span style=\"margin: 0cm 49.55pt 0cm 42.55pt;\"><strong>1.5.7 Explosion<\/strong>. Machinery must be designed and constructed in such a way as to avoid any risk of\u00a0explosion posed by the machinery itself or by gases, liquids, dust, vapours or other\u00a0substances produced or used by the machinery [\u2026].<\/span><\/em><\/p><\/blockquote>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><span style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">In the official Guide to the Machinery Directive the following text is written:<\/span><\/p>\n<blockquote>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">[Guide to 2006\/42\/EC] <em><strong>\u00a7228 Explosion<\/strong><\/em><\/p>\n<p><em><span style=\"margin: 0cm 49.55pt 0cm 42.55pt;\">[\u2026] Although\u00a0the ATEX Directive is not applicable as such to explosion risks generated\u00a0within the machinery itself, [\u2026]\u00a0<\/span><\/em><\/p><\/blockquote>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><strong>CONCLUSIONS<\/strong><\/p>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><span style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">When the Equipment or the Assembly or, in general, <strong>the Machinery,<\/strong> contains a potentially explosive atmosphere, a risk assessment according to EN 1127-1 and all the applicable harmonised standards to the ATEX product Directive, shall be done. <\/span><\/p>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><span style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\">If equipment, like instrumentation, are used inside the machine, those shall be CE Marked according to the ATEX Directive 2014\/35\/EU. However, the Machine itself, if installed in a non-classified area, normally, does not fall under the ATEX Product Directive<\/span>. <strong>An exception<\/strong> would be if the inside athmosphere can generate an ATEX area outside like, for example, in the case of a piping containing exploive gas (Methane) at high pressure.<\/p>\n<p style=\"margin-bottom: 0cm; margin: 0cm 0cm 8pt;\"><strong>But, in general, the inside does not need to be CE marked according to the ATEX Directive.<\/strong><\/p>\n<\/div>            <\/div>\n        \n        \n                <div
